Why do foreign sellers need to register with the Polish BDO Register?
In Poland, as in other European Union Member States, Extended Producer Responsibility (EPR) regulations apply. This means that businesses placing certain products on the market are required to fulfil obligations related to the financing and organisation of waste management systems for waste generated by these products and their packaging.
Foreign sellers are subject to Polish Extended Producer Responsibility (EPR) obligations when they sell products directly to customers (end users) in Poland. The applicable obligations depend on the type of products sold and whether another party has already assumed the relevant producer responsibility.
Any entity subject to EPR regulations in Poland must be registered in the Database on Products and Packaging and on Waste Management (BDO – Baza Danych o Produktach i Opakowaniach oraz o Gospodarce Odpadami). The BDO Register serves as Poland’s national EPR register.
The BDO registration number also serves as the EPR registration number in Poland. Foreign sellers use this number to fulfil their regulatory obligations and when working with online marketplaces and business partners.
Registration in the BDO Register is the first and essential step towards complying with EPR obligations in Poland. Without registration, a business cannot properly fulfil its environmental obligations. Failure to obtain a BDO registration number may result in substantial administrative fines and restrictions on, or suspension of, sales through online marketplaces such as Amazon, Allegro and Temu.
Where should a foreign company submit a BDO registration application?
If a foreign company has a branch in Poland, the application should be submitted to the Marshal’s Office competent for the location of that branch.
If the company does not have a branch in Poland, the application must be submitted to the Marshal of the Mazowieckie Voivodeship.
The application must be submitted in paper form together with the required supporting documents.
After registration, the company receives its BDO registration number and gains access to the BDO system.
How long does BDO registration take?
Once a complete application has been submitted, the competent Marshal’s Office generally has 30 days to process it.
In practice, the processing time depends on the complexity of the case and the authority’s current workload.
When should you register in BDO?
A company must obtain its BDO registration before commencing any activity subject to the registration requirement.
This means your BDO number should be issued before you start selling products on the Polish market.
What are the official BDO registration fees?
Some businesses are required to pay an official registration fee.
The fee amounts to:
• PLN 200 – micro-enterprises,
• PLN 800 – all other businesses.
According to Recommendation 2003/361/EC, an enterprise qualifies as a micro-enterprise if it employs fewer than 10 people and its annual turnover or annual balance sheet total does not exceed EUR 2 million.
What are the penalties for conducting business without the required registration in the Polish BDO Register?
Operating without the required BDO registration may have serious legal consequences.
Polish regulations provide for administrative fines ranging from PLN 1,000 to PLN 1,000,000 for carrying out activities without the required BDO registration.
In addition, online marketplaces such as Amazon, Allegro and Temu increasingly require sellers to provide a valid BDO number or EPR registration number. Failure to obtain the required registration may result in restrictions on selling or suspension of product listings.
